GENERAL INFORMATION
In this agreement, “I”, “we”, “us”, “our” and “Meizer” refers to all services, software (including mobile applications, “apps”) and all other related material, either electronic, physical or otherwise, owned, operated and provided by Meizer, Inc.
“User(s)”, “you”, “buyer(s)” and “seller(s)” refer to the end-user of any/all services, software and any/all other material that is owned, operated and provided by Meizer Inc., as mentioned above.
By accessing and using Meizer, you accept and agree to be bound by the terms and provisions of this agreement. In addition, when using our particular services, you shall be subject to any posted guidelines or rules applicable to such services, which may be posted and modified from time to time. All such guidelines or rules are hereby incorporated by reference into this Privacy Policy.
1. WHAT PERSONAL INFORMATION IS COLLECTED & HOW IT IS USED
The following information is stored by Meizer about its users on its server. This information is accessible, but NOT editable, by the user through the Meizer App by selecting the Information button (i) from the main menu and selecting “My Account”. Personal information and/or data collected by Meizer will be used in the following manner, as described.
USERNAME or “user name” is required to use Meizer and its services. Users are allowed to choose any user name they wish to use, including their real name, if they so wish. A user name will be displayed publicly on Meizer, and as such, users are NOT permitted to use any user name which offends or degrades anyone based on their age, race, background, gender, creed, sexual preference, appearance or any other term or word considered to be derogatory.
FIRST NAME will be used only for the purpose of personalizing the user’s experience, while using the service. Unless otherwise stated, the user’s first name will not be, under any circumstance, made publicly visible to any other users, with the exception of administrative personnel.
LAST NAME use is completely optional and is not required to use Meizer or any of its services. It may be used, in the future, to provide a more personalized experience on Meizer.
E-MAIL provided to Meizer by the user will be primarily used for security puposes. The e-mail provided MUST BE A WORKING AND VALID E-MAIL ADDRESS, and shall be verified using a session token link, which must be clicked on, in order to validate the e-mail, activate the account and unlock features of Meizer that are not enabled for anonymous users of the service. This is done to prevent duplicate accounts, malicious use as well as spamming the Meizer service. Meizer also may, at some point in the future, use your e-mail address for marketing and research purposes such as e-mail offers, special offers, news about the Meizer service (e-mail subscriptions) as well as for Meizer to contact any particular user, for any particular reason. The user shall have the option to ‘opt-out’ of any e-mail subscriptions, should Meizer exercise to have this option in the future.
LAST GPS LOCATION is saved and stored on the server of users who are logged in and have searched for local sales in their area, according to their “Settings”. It is used to locate and provide the user with an accurate listing of sales in their area. This information is kept strictly confidential from other users and may only be accessed only by administrative personnel for research and technical support and/or technical testing purposes.
ACCOUNT CREATED ON is the date and time the user first signed up with Meizer. It kept confidential, and is for informational use only. Meizer may also use it for promotional, market research and statistical purposes at a future date, should Meizer choose to do so.
ACCOUNT UPDATED ON is the date and time of the latest update of the user’s account. This, currently, is only the updating of the user’s “LAST GPS LOCATION”, but may include the updating of the user’s other information at some point in the future.
DEVICE TOKEN ID is a randomly generated number on the user’s device (phone or tablet) which identifies a particular device so that it can receive push notifications. This is a random number, which may change from time to time, at the discretion of the device’s manufacturer and its software. Its sole purpose is to ensure that all push notifications are delivered to the device itself, and consists of a random 16-character alpha-numeric ID, which may be visible to the Meizer development team for development and testing purposes.
If, at any time, the user does not agree with the personal information stored by Meizer on its server, the user shall have the option to completely remove their information (account), including any data posted on its server (Posted Sales) by unlocking and the selecting “Delete My Account” button in the My Account menu, located in the User Information screen.
2. USER-SHARED INFORMATION
The Meizer community is based upon it’s user base. As such, users may post personally identifiable information, including their own addresses, pictures and information about their sales. It is the user’s discretion what information, if any, will be posted. All information posted on Meizer will become publicly visible to its user base. When posting a sale, the following user-provided information is mandatory and will be made public, unless stated otherwise.
HEADLINE is the “title” of a posted sale, used to encourage buyers to visit the sale.
HEADLINE PHOTO is a picture and/or photo provided by the user for the purposes of encouraging buyers to visit the sale. Any/all uploaded photos remain the copyright and intellectual/creative property of their owners/copyright holders, but may be used by Meizer, without permission, for marketing purposes of its service(s). ANY PHOTOS UPLOADED TO MEIZER MUST BE ORIGINAL AND TAKEN BY ITS ORIGINAL CREATIVE OWNER. NO 3RD PARTY PRODUCT IMAGES AND/OR SCREENSHOTS ARE PERMITTED. Meizer reserves the rights to modify and/or delete any information posted on its service, as set forth in this policy and its Terms Of Use.
ADDRESS, CITY, STATE/PROVINCE is required to publicly display the user’s posted sale on a map. This information, as entered by the user, shall be made and displayed publicly. Meizer shall store the translated (GeoCoded) GPS coordinates of the address for technical purposes only. This GeoCoded information is not publicly displayed.
SALE START TIME/END TIME is stored on the server and will be made visible to the public in order to inform users of the date and time the posted sale will begin and end.
SALE DESCRIPTION is mandatory in order to inform buyers of what the sale is about, as well as to enable buyers to search for keywords within sales. Sellers are encouraged to describe their sale as accurately as possible and to use keywords (such as: toys, games, tools, clothes, CDs, DVDs, etc) to make their sale searchable for these keywords.
All user-shared information is posted by the seller. MEIZER MAKES NO CLAIM TO THE ACCURACY OR VALIDITY OF ANY INFORMATION POSTED ON ITS SERVICE.
All posted sales may be deleted by the individual account holder who posted the sale information. It will permanently deleted from the Meizer server, and will not be publicly visible to anyone. Despite this option, users understand that, during the time in which the sale is posted and deleted, it may be visible to any member of the public. Users who do not wish to make this information available publicly must not post it.
3. USE OF WEB-TRACKABLE SOFTWARE (“COOKIES”)
Users and visitors to Meizer’s web site may have web-tracking data code, referred to as “cookies” installed in their browser. These cookies may be used by Meizer for statistical, marketing and/or technical purposes. The purpose of obtaining such information is to get usage statistics of visitors to Meizer’s web site, including their location/country of origin as well as how the Meizer web site is used by its visitors. This research is used to enhance the services provided by Meizer and provide vital information about the future growth of the Meizer community. It may also by used for technical research and/or support of the web site itself.
4. PRIVACY POLICY FOR MINORS (UNDER 18 YEARS OF AGE)
Meizer does not distinguish between the data collected from adults and data collected from minors. All data collected and stored does not contain personally identifiable age information about any particular user. It is highly recommended that any minors using or wishing to use Meizer or any of its services obtain permission from a parent/legal guardian.
5. REPORTING OF PERSONALLY IDENTIFIABLE INFORMATION
Under rare and extreme circumstances, should any user(s) violate the Terms Of Use policy and cause/have caused and/or have intent to cause personal injury and/or death, that user’s personally identifiable information may be made available, at Meizer’s discretion, to local, state and/or federal law enforcement agencies/authorities (the “entity”) for investigative/legal purposes. The user may or may not receive notice of such intent, at Meizer’s discretion, or (for security/legal reasons) at the discretion of the requesting entity.
6. CHANGES TO PRIVACY POLICY
This privacy policy may be modified in the future, as may be required by Meizer’s practices. The end-user shall, from time to time, check this privacy policy for any changes, and accept or decline them as they deem necessary.
ALL USERS MUST AGREE TO, AND ABIDE BY, ALL THE TERMS OF THIS AGREEMENT. ANY PARTICIPATION IN AND/OR USE OF THIS SERVICE SHALL CONSTITUTE ACCEPTANCE OF THE TERMS AND CONDITIONS SET FORTH HEREIN. SHOULD ANY USER DECLINE THIS AGREEMENT, THEY MUST CEASE AND DESIST THE USE OF THIS SERVICE AND REMOVE ANY/ALL MATERIAL (SOFTWARE, ETC.) FROM THEIR POSSESSION (ELECTRONIC OR OTHERWISE).
